FIGHT FESTERS OVER MEDICAL POT LAWSUIT
Santa Fe New Mexican, Phaedra Haywood, February 29, 2012

The New Mexico Department of Health sent out notification letters to 102 applicants for State medical cannabis producer licenses.  Six of the applicants sued the State last April, contending that the DOH violated applicants' constitutional rights when it refused to review, accept, or deny the applications.  The reviews announced on Feb. 29 and the letters sent out by the DOH were the result of an interim settlement agreement.

According to DOH Secretary Catherine Torres, only 4 of the 102 applications met the program standards.  Of the six Plaintiffs in the lawsuit, only one was deemed acceptable.  The letters explained that none of the applicants will actually be issued licenses at this time.  As for those whose applications were rejected, they can apply again, but only after the DOH re-starts its application process sometime in the future.  Copies of acceptance and rejection letters are here.
